1. Acceptance of Terms

By accessing or using SRS Deutsch ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Description of Service

SRS Deutsch is a spaced repetition system (SRS) web application designed to help users learn German vocabulary. The Service provides:

• Flashcard-based learning with the SM-2 spaced repetition algorithm
• AI-powered example sentence generation and text-to-speech pronunciation
• Dictionary lookup integration with multiple sources (LEO, FreeDict, WikDict)
• Progress tracking and statistics for your learning journey

3. User Accounts

Account Registration

To use the Service, you must create an account by providing a valid email address and password. You agree to provide accurate, current, and complete information during registration and to update this information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials.

Account Security

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to protect your account credentials.

Account Termination

You may delete your account at any time through the Settings page. We may suspend or terminate your account if you violate these terms or engage in fraudulent or illegal activities. Upon termination, your data will be deleted according to our data retention policies.

4. Subscriptions and Payments

Subscription Tiers

SRS Deutsch offers the following subscription plans:

• Free - $0/forever - 15 AI examples/day, 10 pronunciations/day, 3 decks with 100 cards each
• Basic - $1/month - 50 AI examples/day, 25 pronunciations/day, 10 decks with 500 cards each
• Full Access - $5/month - 500 AI examples/day, 250 pronunciations/day, 100 decks with 5000 cards each, vocabulary-controlled examples

Billing

Paid subscriptions are billed monthly through Stripe. Your subscription will automatically renew each month unless cancelled. You authorize us to charge your payment method on file for recurring payments. Prices are in USD and may be subject to applicable taxes.

Cancellation

You may cancel your subscription at any time through the Stripe billing portal accessible from your Settings page. Cancellation will take effect at the end of your current billing period, and you will retain access to paid features until then. No prorated refunds are provided for partial months.

5. Acceptable Use

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service. Specifically, you agree not to:

• Use the Service for any illegal purpose or to violate any laws
• Attempt to gain unauthorized access to other user accounts or our systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated scripts to access the Service or extract data without permission
• Impersonate any person or entity or misrepresent your affiliation
• Upload or transmit viruses, malware, or other malicious code

6. Content and Intellectual Property

Your Content

You retain ownership of the vocabulary cards, decks, and notes you create using the Service. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you. You are responsible for ensuring your content does not infringe on third-party rights.

AI-Generated Content

Example sentences and pronunciation audio generated by our AI features are provided as learning aids. While we strive for accuracy, AI-generated content may contain errors. You acknowledge that AI-generated example sentences should be used for educational purposes and verified when accuracy is critical. We do not guarantee the grammatical correctness or appropriateness of all AI-generated content.

7. Intellectual Property Rights

The Service, including its design, features, and content (excluding user-generated content), is owned by SRS Deutsch and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our express written permission.

8. Third-Party Services

The Service integrates with various third-party services to provide its functionality. Your use of these services is subject to their respective terms and privacy policies:

• Stripe - Payment processing (subject to Stripe's terms of service)
• Groq (LLaMA) - AI example sentence generation
• OpenAI - Text-to-speech pronunciation
• LEO Dictionary - German dictionary lookups (public data)

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SPECIFICALLY:

• We do not warrant that the Service will be uninterrupted, secure, or error-free
• We do not guarantee the accuracy, completeness, or usefulness of AI-generated content
• We may modify, suspend, or discontinue any aspect of the Service at any time

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SRS DEUTSCH AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless SRS Deutsch, its operators, affiliates, and their respective officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

12. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by posting a notice on the Service or sending an email. Your continued use of the Service after such modifications constitutes acceptance of the updated terms. If you do not agree to the modified terms, you should discontinue using the Service.

13. Governing Law and Disputes

These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or the Service shall be resolved through good-faith negotiation. If a dispute cannot be resolved amicably, it may be submitted to binding arbitration or the appropriate courts, depending on your jurisdiction.
